Which permit applies and who qualifies
A residence permit for multinational company workers in Panama exists only for foreign staff of companies holding a SEM License. The MICI explains that the regime lets a company run a regional headquarters from Panama and support related parties abroad. Its base is Law 41 of August 24, 2007.
According to the MICI page on SEM visas, a worker has three routes: the Permanent Personnel Visa, which the SEM Office guide assigns to administrative and executive level workers; the Temporary Personnel Visa, for technical services or training over a short period; and permanent residence, after five years on the permanent visa.
To qualify, the company needs a valid license, because every application carries a certification from the Technical Secretariat of the Licensing Commission, and the worker needs a contract with that headquarters. Article 30 refers to foreign employees of trust for upper and middle management. Without a SEM license the case falls outside, and other residency routes apply.
Documents the official sheet asks for
The permanent visa is governed by MICI sheet TMS-DC-001, revised on November 1, 2017. Its documents:
| Document | What the sheet requires |
|---|---|
| Power of attorney and application | Granted by the headquarters’ legal representative and by the worker. |
| Photos and passport | Three ID-size photos and a complete passport copy certified by a Panamanian notary, with at least three months of validity. |
| Criminal record | From the country of origin or residence. With two years or more in Panama and no absences over thirty consecutive days, the DIJ certificate is accepted. |
| Health and sworn statement | Certificate from a licensed physician in Panama, under three months old, and the Migration personal background form. |
| Employment and responsibility letter | Signed by the legal representative with a notarized signature. States job title, term, duties, salary, insurance and that the company covers repatriation. |
| Insurance and certification | Medical policy, group or individual, and Technical Secretariat certification that the company operates under Law 41. |
Foreign documents must be apostilled or authenticated and, if not in Spanish, translated by an authorized public translator. See the guide to apostille and translation.
For the temporary visa, sheet TMS-DC-003 asks for a power of attorney, photos, passport, criminal record, a company letter with the contract for technical services or training, and the Technical Secretariat certification. The National Migration Service sheet adds health, a sworn statement and two certified checks, B/.250.00 to the National Treasury and B/.800.00 to Migration. The two sheets differ; confirming with the SEM Office which one applies is advisable.
The process, step by step
The sheet states that every SEM visa application is filed at the MICI’s General Directorate of Multinational Headquarters, at Plaza Edison, third floor.
- Close the hire and gather the documents, with apostille and official translation.
- Give up any other migration category, if one exists. This is filed first with the National Migration Service.
- Send the advance digital copy to sem@mici.gob.pa, one PDF per document: power of attorney and application, passport, employment letter and policy.
- File the original documents at the MICI.
- Receive the visa and ID card, which under the law carries multiple exit and re-entry permission for as long as it is valid.
Neither the sheet nor the law sets a processing time; see how long each immigration procedure takes. Common mistakes: an expired health certificate, a letter without the notarized signature, documents without apostille and a skipped digital copy.
Validity and permanent residence
Article 27 provides that the visa is granted for a term no longer than the contract or five years, and that the ID card is valid for five years. The MICI and the sheet add that it can be renewed for the same period, with no limit on renewals, unless the contract is shorter. A renewal repeats the requirements except the criminal record, with a copy of the card. The temporary visa lasts up to three months and can be extended once for three more.
When the employment ends, the SEM Office guide provides a six-month stay permit from the cancellation of the visa, and the waiver sheet requires reporting the end of employment to Migration within twenty business days.
After five years from the approval of the permanent visa, the MICI says the worker can request permanent residence. Sheet TMS-DC-006, for those who keep working at a SEM, asks for a company letter, a bank certification, Social Security Fund affiliation and a B/.250.00 check to the National Treasury. Sheet TMS-DC-005, for those who no longer work there, requires proof of investment of at least B/.150,000.00 in a fixed-term deposit of three years or real estate free of liens. According to the MICI, a permanent resident who stays at a SEM pays income tax, social security and educational insurance.
Dependent family members
Article 26 mentions the spouse, children who are minors or under twenty-five and studying, and parents who remain in Panama under the worker’s responsibility. The SEM Office guide adds a partner united for five years and children with disabilities.
Sheet TMS-DC-004 asks for each dependent documents equivalent to the worker’s, plus proof of kinship, a responsibility letter from the worker and, for adult children, proof of studies and of single status.
Dependents are not authorized to work: article 30 clarifies that the labor exception does not reach them. The guide says they can change status through the MICI single window; see also the work permit under family reunification. For a dependent to request permanent residence, TMS-DC-005 says five years on the visa and TMS-DC-006 says two.
How it differs from a regular work permit
Under the general regime, a foreigner with residence also needs a work permit from the Ministry of Labor. Under the SEM regime, article 27 establishes that once the visa is granted, no further procedure or permit from another state entity is needed to work or reside, and the MICI is the entry point. In exchange, article 31 limits work to the headquarters, and article 34 requires the company to cover the worker and dependents with medical insurance.
A person who enters under the regime and stays without working at the headquarters risks a fine of up to B/.5,000.00, loss of the visa and repatriation at the company’s expense (article 37). If the headquarters’ license is cancelled, the visas are cancelled too (article 20). Other categories: visas in Panama.
Myths and reality
- Myth: an ordinary work permit is enough. Reality: the SEM visa suffices to work and reside (article 27).
- Myth: the SEM visa works for any employer. Reality: article 31 bars other work activities.
- Myth: every foreign company with an office in Panama is a SEM. Reality: it needs a license, proved before the Technical Secretariat.
- Myth: the SEM visa is already permanent residence. Reality: they are different categories; permanent residence comes after five years.
- Myth: dependents can work on their visa. Reality: they need a work permit or a change of status.
- Myth: when the contract ends, the worker must leave that day. Reality: the SEM Office guide provides a six-month stay permit.
